1. Acceptance of Terms

By accessing or using the BeachClubDXB website (beachclubdxb.com) and its services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our platform.

These Terms constitute a legally binding agreement between you ("User", "you") and BeachClubDXB ("Company", "we", "us"). We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Description of Service

BeachClubDXB is an online marketplace and booking inquiry platform that:

• Provides information about beach clubs, hotel pools, and day pass experiences in Dubai
• Enables users to submit booking inquiries to venue partners
• Facilitates communication between users and venue operators
• Publishes editorial content, venue reviews, and comparison guides about Dubai beach experiences
• Distributes a newsletter with deals, new openings, and beach club information

BeachClubDXB is a booking inquiry facilitator, not a venue operator or direct booking agent. When you submit a booking inquiry through our platform, you are entering into a direct booking relationship with the venue. BeachClubDXB is not a party to that booking contract.

3. Eligibility

By using our Service, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into binding agreements
• All information you provide is accurate, current, and complete
• You will use the Service only for lawful purposes and in accordance with these Terms
• You are not accessing the Service from a jurisdiction where such access is prohibited

4. Booking Inquiries

4.1 Nature of Inquiries

Booking inquiries submitted through BeachClubDXB are forwarded directly to the relevant venue partner. A booking is not confirmed until you receive written confirmation from the venue. Submission of an inquiry does not guarantee availability or booking confirmation.

4.2 Pricing

All prices displayed on BeachClubDXB are provided by venue partners and are subject to change. While we strive to maintain accurate pricing, we cannot guarantee that prices displayed are current at the time of your inquiry. The confirmed price will be communicated by the venue at booking confirmation.

4.3 Venue Policies

Each venue has its own policies regarding dress codes, minimum spend, age restrictions, reservation times, and conduct. By booking through BeachClubDXB you agree to comply with the venue's policies. Failure to comply may result in denied entry without refund.

4.4 No Booking Fees

BeachClubDXB does not charge users a booking or platform fee. If a venue charges additional fees not disclosed on our platform, please contact us so we can update their listing.

5. Cancellations and Refunds

Cancellation policies are set by individual venues and are displayed on each venue profile page. As a general guide:

• Most venues offer free cancellation up to 48 hours before your visit
• Some venues require 72–96 hours notice for group bookings and cabana reservations
• Same-day cancellations may be subject to a cancellation fee or no refund
• No-shows are typically non-refundable

Full details are available in our Cancellation Policy. Since payment is made directly to venues, refunds are processed by the venue. BeachClubDXB can assist in mediating disputes but is not responsible for venue refund timelines.

6. User Conduct

When using BeachClubDXB, you agree not to:

• Submit false, misleading, or fraudulent booking inquiries
• Use our platform to harvest data, scrape content, or engage in automated data collection
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Submit spam, unsolicited communications, or off-topic enquiries through our forms
• Attempt to interfere with, compromise, or disrupt the Service or its security
• Use the platform to promote competing services or solicit users away from the platform
• Violate any applicable laws or regulations in the UAE or your country of residence

Violation of these conduct rules may result in immediate termination of your access to the Service and, where applicable, referral to relevant authorities.

7. User-Generated Content

If you submit a review, rating, photo, or other content through our platform ("User Content"), you grant BeachClubDXB a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, and display that content in connection with operating and promoting the Service.

You represent that you own or have the right to submit the User Content, and that it does not violate any third-party rights. BeachClubDXB reserves the right to remove User Content that is inaccurate, defamatory, offensive, or in violation of these Terms.

8. Venue Partners

BeachClubDXB lists venue information provided by or on behalf of venue operators. While we strive for accuracy, we cannot guarantee that all venue information is current, complete, or error-free. Venue details including pricing, policies, amenities, and availability are subject to change without notice.

BeachClubDXB is not responsible for:

• The quality, safety, or suitability of any venue or its services
• Inaccuracies in venue-provided information
• Venue closures, policy changes, or service modifications
• The conduct of venue staff or other guests
• Any loss or injury suffered at a venue

9. Limitation of Liability

To the maximum extent permitted by applicable law, BeachClubDXB, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Your use of or inability to use the Service
• Any booking made or not made through the platform
• Any venue experience, service quality, or incident at a venue
• Inaccuracies in venue pricing, availability, or policy information
• Unauthorised access to your data caused by factors beyond our reasonable control

Our total liability to you for any claim arising from use of the Service shall not exceed AED 500 or the amount you paid to BeachClubDXB (if any) in the 12 months preceding the claim, whichever is less.

Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or any other matter that cannot be excluded by law.

10. Intellectual Property

All content on BeachClubDXB — including but not limited to text, venue descriptions, editorial guides, design elements, logos, and code — is the intellectual property of BeachClubDXB or its licensors. You may not reproduce, distribute, or create derivative works from our content without prior written permission.

Venue names, logos, and images used on venue profile pages are the property of the respective venues and are used with permission or under fair use for editorial purposes.

11. Privacy

Your use of BeachClubDXB is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data collection and use practices as described in the Privacy Policy.

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from or related to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

13. Changes to Terms

BeachClubDXB reserves the right to modify these Terms at any time. Changes will be effective upon posting to this page with an updated "Last Updated" date. We recommend reviewing these Terms periodically. Material changes will be communicated via email to newsletter subscribers where reasonably practicable.
